The second issue, this question also came to me at the Masjid an-Nabawī, about the ruling on dealing with the companies, Tamara and Tabby (…)
The format of its hidden contract; it was revealed to me today that they are not written (upfront), but rather they are hidden; the format is as follows:
You buy merchandise from them in installments. Then, if the time exceeds the installment deadlines, they impose a new amount on you, which they call a penalty.
This penalty in its reality, is but the ribā that was prevalent in the days of ignorance (Jāhiliyyah). Settle (the amount) else pay more. This is the ribā that was present in the pre-Islamic era. Make the payment or pay an increased amount. Meaning, either pay up now, or they raise the price on you.
What is the difference?
The difference is only in the name by which they call it. They all charge a penalty for this, and many people deal with it in hospitals, for example, in doctors’ clinics and so on. Pay attention, this is a great danger, it is one of the doors of ribā.
“The Prophet -may Allāh’s prayers and peace be upon him- cursed the one who takes ribā, the one who pays it, the one who writes it down, and it’s two witnesses.”
Narrated by Jābir -may Allāh be pleased with him- in Ṣāḥiḥ Muslim 1598
Be careful, Oh slave of Allāh!
What’s strange is that someone gave a fatwā that it’s permissible. However, our senior scholars¹ negated it and clarified that it’s a shade of ribā and warned against it.
Another strange thing is that they say that “this fine that we impose on those who are late in paying is to be spent on the poor and the needy.”
I tell them:
“Like one who feeds orphans from earnings by losing chastity ***
Woe to you, leave off fornication and leave off giving charity.”
May Allāh grant success to all in beneficial knowledge and good deeds. And peace and blessings be upon our Prophet Muḥammad

المسألة الثانية جاءني أيضا سؤال في المسجد النبوي عن حكم التعامل مع شركة تمارا وتابي (…)
وصورة عقودها المخفية، اليوم ابرزت أنها غير مكتوبة وإنما هي مخفية. صورة عقودها المخفية كالاتي:
تشتري منهم بضاعة بالتقسيط.
ثم إذا تجاوزت الوقت المواعيد التقسيط فرضوا عليك مبلغا جديدا، يسمونه غرامة. وهذه الغرامة هي بعينها ربا الجاهلية. اقضي وإلا زد. هذا الربا كان موجودا في الجاهلية. اقضي وإلا زدت يعني اما اسدد الآن وإلا أن ارفع عليك السعر. ما الفرق؟ الفرق في الاسم بالمسمى. فكلهم يضربون غرامة على هذا وكثير من الناس يتعاملون بها. يتعاملون في المستشفيات وفي مثلا، عيادات الأطباء وما إلى ذلك. انتبهوا هذا خطر عظيم وهو باب من أبواب الربا وقد
“لعن النبي صلى الله عليه وسلم آكِلَ الرِّبَا وَمُوكِلَهُ وَكَاتِبَهُ وَشَاهِدَيْهِ “
فانتبه يا عبد الله.
العجيب أن أحد الناس قد افتى بجواز ذلك. ولكن مشايخنا الكبار انكروا هذه عليه وبينوا أن هذا لون من ألوان الربا فاحذروا من ذلك. والعجيب أنهم يقولون هذه الغرامة نحن التي نفرضها على المتأخرين في السداد يكون نصرفها على الفقراء والمساكين. اقول لهم
ومُطعمة الأيتام من كسب فرجها ***
لكن ويل (لك) لا تزني ولا تتصدقي.
